BOC-3 Filed but MC Still Pending: What to Check
If your BOC-3 is filed but your MC is still pending, the most likely reason is that FMCSA doesn't have your insurance filing yet. A BOC-3 alone never turns authority on. FMCSA also needs your insurance in effect and on file, plus review time. In our data, 2,874 of 2,945 pending carriers with a BOC-3 had no insurance filing.

What's still missing if my BOC-3 is on file?
Almost always, it's the insurance filing. FMCSA says it won't grant operating authority until the minimum required insurance is in effect and on file with it, and your BOC-3 can't stand in for that.
Here's what that looks like in our data. We looked at the 11,038 carriers whose MC applications first showed up in FMCSA's public data between July 1 and August 10, 2026, and checked where each one stood on October 8, 2026.
| Still pending on Oct 8, 2026 | Carriers |
|---|---|
| BOC-3 on file, no insurance filing | 2,874 |
| BOC-3 and insurance both on file | 71 |
| Insurance on file, no BOC-3 | 102 |
| Neither on file | 1,828 |
So if your record shows the BOC-3 and nothing under insurance, you've found your answer. The BOC-3 is the cheap, quick step. Insurance is the one people stall on.
How do I confirm the BOC-3 actually landed?
Look at your public FMCSA record, not your receipt from the process agent. Paying for a BOC-3 and having it show on your record aren't the same event.
Enter your USDOT or MC number and First Load shows whether a BOC-3 and an insurance filing are on file, side by side. If you'd rather use FMCSA's own screens, here's how to check your status on SAFER and Motus. If the BOC-3 doesn't show a few days after you paid, ask your process agent to confirm they filed it under the exact name and USDOT number on your application.
Who files the insurance, and what do I ask for?
Your insurance company files it, not you. For most new for-hire property carriers, that's the BMC-91 or BMC-91X filing, sent to FMCSA electronically by the insurer.
FMCSA's insurance page tells new applicants to contact their insurance provider to request the filing right after they get their docket number. When you call, ask three things: has the filing been made, what's its effective date, and was it filed under your exact company name and docket number?
If you don't have a policy yet, that's the step to work on. You can get quotes from up to three agencies that write new authorities with one form.
Is there a deadline for the insurance filing?
Yes, and it's shorter than most people expect. FMCSA says that if the insurance isn't filed within 20 days of your application being published in the FMCSA Register, it sends a decision saying the application will be dismissed unless you comply within 60 days.
That notice isn't a dismissal by itself. It's the clock telling you to get the filing done. If your application does get dismissed, you'd be starting over, so don't let the insurance sit.
What if the BOC-3 and insurance are both on file?
Then it's usually time, the insurance effective date, or a mismatch. That's a small group: only 71 of the 4,875 pending carriers in our cohort had both filings showing.
- It may just need time. FMCSA says first-time applications may take 20 to 25 business days, and longer if they're picked for extra review.
- Check the effective date. A filing can appear before the coverage starts. FMCSA needs the insurance in effect, not just filed.
- Look for a mismatch. FMCSA warns that the business name and address on your filings need to match your application exactly, and that any difference delays the grant.
We cover that situation in detail, with our own timing data, in insurance filed but MC still pending.
How long after both filings does an MC go active?
There's no fixed countdown, and the BOC-3 doesn't start one. Of the 11,038 carriers in our cohort, 5,448 had been granted authority by October 8, 2026, and the median wait from application to grant was 28 days.
For the full timeline, including the 10-day protest period and what makes some applications take longer, see how long MC authority takes.
Who should I call?
Call the person who controls the missing piece. Your process agent controls the BOC-3. Your insurance company controls the insurance filing. FMCSA controls the grant.
If both filings are correct and it's been well past 25 business days, FMCSA is the right call. A company that phoned you because your application went public doesn't control any of those three.
Frequently asked questions
Does a BOC-3 make my MC active?
No. The BOC-3 is one of the filings FMCSA needs, but it doesn't activate anything on its own. FMCSA also needs your insurance in effect and on file, and your application has to finish its review.
Do I need to refile my BOC-3 if my MC is still pending?
Usually not. If the BOC-3 shows on your record under the right name and USDOT number, filing it again won't speed anything up. Only refile through your process agent if something on it is wrong, like an old address or a misspelled company name.
Can my application be dismissed while I wait on insurance?
Yes. FMCSA says that if the insurance isn't filed within 20 days of your application's publication in the FMCSA Register, it sends a decision giving you 60 days to comply before dismissal. Get the filing done well before that.
My BOC-3 and insurance are filed. Can I start hauling?
Not until FMCSA grants the authority and it shows active. Filings on record aren't the same as active authority. Here's what you can and can't do while your MC is pending.
